BY ACCESSING OR USING WWW.SHOCKWAVEMOTO.COM (THE "SITE"), PLACING AN ORDER, OR COMPLETING A PURCHASE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST NOT ACCESS OR USE THIS SITE.


1. PARTIES AND AGREEMENT

These Terms of Service constitute a legally binding agreement between you ("Customer," "User," "you," or "your") and ShockWave Moto ("Company," "we," "us," or "our"), the operator of www.shockwavemoto.com, a Shopify-powered e-commerce store. ShockWave Moto is a reseller of (a) decorative 3D-printed scale model bicycles sourced domestically within the United States and (b) e-bike accessories, including titanium bolts and e-bike lighting products, which may be sourced from international suppliers.

These Terms govern every interaction you have with the Site, including browsing, account registration, placing orders, and accepting delivery of products. Your continued use of the Site constitutes ongoing acceptance of any updated version of these Terms.


2. PRODUCT DISCLAIMER

ShockWave Moto sells aftermarket, replica-style, and inspired accessories and decorative products. Certain products on this Site may reference brand names such as Fox, Protaper, Baja Designs, Surron, Super73, and others. These products are NOT authentic products manufactured, endorsed, sponsored, or affiliated with those brands in any way. They are non-genuine replica or inspired products sold for aesthetic, decorative, or functional purposes only.

All third-party brand names, trademarks, and logos referenced on this Site are the property of their respective owners and are used solely for descriptive identification purposes. ShockWave Moto makes no claim of association with or endorsement by any such brand.

By purchasing any product from ShockWave Moto, you acknowledge that you understand the non-genuine nature of replica or inspired products and that you are not purchasing an authentic branded item.


3. NATURE AND DESCRIPTION OF PRODUCTS

3.1 – 3D Printed Decorative Model Bikes

ShockWave Moto sells three-dimensional-printed scale model replicas of popular e-bike styles, including but not limited to the Surron and Super73 style models. THESE PRODUCTS ARE SOLD STRICTLY AND EXCLUSIVELY AS DECORATIVE DISPLAY ITEMS AND COLLECTIBLES. They are NOT functional bicycles, NOT rideable vehicles, NOT toys intended for children, and NOT suitable for any use other than static display.

By purchasing a 3D-printed model bike, you expressly acknowledge and agree that:

  • The product is a decorative scale model only and has no functional, mechanical, or electrical capability.

  • The product is NOT a toy and is NOT intended for children. It contains small parts that may present a choking hazard and sharp edges that may cause injury. Keep out of reach of persons under 18 years of age.

  • You will not attempt to ride, operate, modify, or mechanically alter the product in any way.

  • ShockWave Moto makes no warranty that the model will accurately represent any particular real-world vehicle in dimension, color, or detail.

  • The 3D-printed nature of the product means minor surface imperfections, layer lines, color variation, and dimensional tolerances are inherent characteristics of the manufacturing process and do not constitute defects.

  • You assume all risk of injury or property damage resulting from any use of the product inconsistent with its nature as a decorative display item.

3.2 – E-Bike Accessories (Titanium Bolts and E-Bike Lights)

ShockWave Moto also sells e-bike accessories, including titanium bolts and lighting products. These products are sourced from international suppliers, which may include vendors on Alibaba, AliExpress, or similar platforms, and are resold to consumers in the United States.

By purchasing e-bike accessories, you expressly acknowledge and agree that:

  • You are solely responsible for determining the compatibility of any accessory with your specific bicycle or e-bike model before purchasing or installing it.

  • ShockWave Moto does not provide installation services and is not responsible for any damage, injury, or loss resulting from improper installation or use of any product.

  • Titanium bolts and fasteners must be installed by a qualified bicycle mechanic using proper torque specifications. Over-tightening or under-tightening can result in component failure, personal injury, or death. ShockWave Moto expressly disclaims all liability for improper fastener installation.

  • E-bike lights must be installed in accordance with all applicable federal, state, and local laws governing bicycle lighting and road use. You are solely responsible for ensuring your bicycle complies with all applicable regulations.

  • International sourcing means product specifications, materials, certifications, and quality may vary. ShockWave Moto does not independently test or certify products for safety beyond representations made by the supplier.

  • Some products may not carry UL, CE, or other safety certifications. You acknowledge this risk and assume all responsibility for evaluating product suitability for your intended use.

3.3 – No Endorsement of Real Brands

References to brand names such as "Surron," "Super73," or any other e-bike manufacturer on this Site are made solely for descriptive and comparative purposes to communicate the style or aesthetic of a product. ShockWave Moto is not affiliated with, endorsed by, or in any way connected to these manufacturers. All third-party trademarks are the property of their respective owners.


4. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH THE PURCHASE, OWNERSHIP, HANDLING, AND USE OF ANY PRODUCT SOLD BY SHOCKWAVE MOTO, INCLUDING BUT NOT LIMITED TO:

  • Physical injury, death, or property damage arising from misuse of any product;

  • Injury arising from improper installation of fasteners, lights, or other accessories;

  • Product failure due to use inconsistent with the product's intended purpose;

  • Allergic reactions or sensitivities to materials used in 3D-printed models or accessories;

  • Damage to your e-bike, bicycle, or other property resulting from incompatible accessory fitment;

  • Any harm resulting from use of products by children or other persons for whom the products are not intended.

BY PURCHASING FROM SHOCKWAVE MOTO, YOU RELEASE, DISCHARGE, AND HOLD HARMLESS SHOCKWAVE MOTO, ITS OWNER(S), EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, COSTS, EXPENSES, AND DAMAGES OF ANY NATURE, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF ANY PRODUCT.


5. DISCLAIMER OF WARRANTIES

ALL PRODUCTS SOLD BY SHOCKWAVE MOTO ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. SHOCKWAVE MOTO SPECIFICALLY DISCLAIMS ALL:

  • Implied warranties of merchantability and fitness for a particular purpose;

  • Warranties that products are free from defects in materials or workmanship;

  • Warranties regarding the accuracy of product descriptions, photographs, or specifications;

  • Warranties that products meet any safety standard, certification, or regulatory requirement;

  • Warranties of title or non-infringement with respect to third-party intellectual property;

  • Any warranties arising from course of dealing or usage of trade.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the maximum extent permitted by law.


6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHOCKWAVE MOTO AND ITS OWNER(S), OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, punitive, or exemplary damages;

  • Loss of profits, revenue, data, goodwill, or business opportunities;

  • Personal injury or property damage of any nature arising from your use of any product;

  • Any damages arising from delay in shipping or failure to fulfill an order due to circumstances beyond our control.

IN NO EVENT SHALL SHOCKWAVE MOTO'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR PURCHASE OF PRODUCTS EXCEED THE GREATER OF: (A) THE ACTUAL PURCHASE PRICE PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.


7. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless ShockWave Moto and its owner(s), employees, agents, suppliers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your breach of any provision of these Terms;

  • Your use or misuse of any product purchased from ShockWave Moto;

  • Your violation of any applicable law, regulation, or third-party right;

  • Any claim by a third party that arises from your use of a product sold by ShockWave Moto;

  • Injury or damage caused by a product you gifted or transferred to another person after purchase;

  • Your failure to install accessories properly or to consult a qualified professional before installation.


8. PRODUCT SAFETY AND COMPLIANCE

7.1 – Decorative Items Are Not Toys

3D-printed model bikes sold by ShockWave Moto are decorative collectibles intended for adults. They are NOT designed, tested, or certified under the Consumer Product Safety Improvement Act (CPSIA), ASTM F963, or any other toy safety standard. They should never be given to or used by children under 18. ShockWave Moto disclaims all liability for injuries resulting from use by minors.

7.2 – International Products and Import Compliance

E-bike accessories sourced from international suppliers, including those obtained via Alibaba or AliExpress, are sold as-is. ShockWave Moto makes no representation that such products comply with all U.S. safety standards, import regulations, or agency requirements. You assume all responsibility for verifying compliance with any applicable federal, state, or local requirements before use, including any FCC, CPSC, or DOT regulations that may apply to lighting or fastener products.

7.3 – User Responsibility for Safe Use

You are responsible for using all products in a safe and lawful manner. If you are unsure how to install or use any product, you should consult a qualified bicycle mechanic or other relevant professional before proceeding. ShockWave Moto strongly encourages users to follow all manufacturer instructions included with any product and to comply with applicable local road and safety laws.


9. ORDERS, PRICING, AND PAYMENT

All orders placed through the Site are subject to acceptance by ShockWave Moto. We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases involving suspected fraud, pricing errors, or product unavailability. Prices displayed on the Site are in U.S. Dollars and are subject to change without notice. We are not responsible for typographical errors in pricing. If a product is listed at an incorrect price, we reserve the right to cancel the order and issue a full refund.

Payment is processed through Shopify's secure checkout platform. By submitting your payment information, you represent that you are authorized to use the payment method provided. ShockWave Moto does not store credit card information on our servers.


10. SHIPPING AND DELIVERY

ShockWave Moto ships to addresses within the United States. Estimated shipping times are provided as a courtesy and are not guaranteed. We are not liable for delays caused by the shipping carrier, weather events, customs processing, or other circumstances beyond our control. Risk of loss and title for products passes to you upon our delivery of the product to the carrier.

If a package is lost or damaged in transit, you must notify us within 14 days of the expected delivery date. We will work with you and the shipping carrier to investigate the claim, but we cannot guarantee resolution or replacement in all cases. ShockWave Moto is not responsible for packages that are confirmed delivered but reported as missing after delivery.


11. RETURNS, REFUNDS, AND EXCHANGES

Returns and refunds are handled in accordance with our Refund Policy, which is incorporated into these Terms by reference. Generally:

  • Decorative 3D-printed bikes may be returned within 14 days of delivery if they are unused, undamaged, and in original condition.

  • E-bike accessories may be returned within 14 days of delivery if unused and in original packaging.

  • Items that show signs of installation, modification, or use are not eligible for return.

  • Return shipping costs are the responsibility of the Customer unless the return is due to a fulfillment error on our part.

  • Refunds, if approved, will be issued to the original payment method within 7 to 10 business days.

ShockWave Moto is not responsible for products lost or damaged during return shipment. We recommend insuring return shipments for the value of the product.


12. INTELLECTUAL PROPERTY

All content on the Site, including but not limited to text, graphics, logos, photographs, product images, and software, is the property of ShockWave Moto or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on this Site without our prior written permission.

13. USER CONDUCT AND PROHIBITED ACTIVITIES

By using the Site, you agree not to:

ShockWave Moto uses Shopify as its e-commerce platform; Shopify's own privacy practices also apply to information processed through checkout.


15. THIRD-PARTY SUPPLIERS AND RESELLER STATUS

ShockWave Moto is an independent reseller and is not the original manufacturer of any product sold on this Site. We source 3D-printed model bikes from a domestic U.S.-based individual and source e-bike accessories from international suppliers. ShockWave Moto does not manufacture, engineer, or independently test any product for safety, durability, or compliance.

TO THE EXTENT PERMITTED BY LAW, ANY MANUFACTURER'S WARRANTIES THAT MAY EXIST ARE BETWEEN YOU AND THE ORIGINAL MANUFACTURER. SHOCKWAVE MOTO MAKES NO ADDITIONAL WARRANTIES BEYOND WHAT IS EXPRESSLY SET FORTH IN THESE TERMS.


16. GOVERNING LAW AND DISPUTE RESOLUTION

15.1 – Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.

15.2 – Informal Resolution

Before initiating any formal proceeding, you agree to attempt to resolve any dispute informally by contacting ShockWave Moto directly. We will use reasonable efforts to resolve any dispute within 30 days of notice.

15.3 – Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the purchase of any product shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA). You and ShockWave Moto each waive the right to a jury trial and the right to participate in any class action, class arbitration, or other representative proceeding.

15.4 – Venue

To the extent any matter proceeds in court rather than arbitration, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Florida.


17. CLASS ACTION WAIVER

YOU AND SHOCKWAVE MOTO EACH AGREE THAT ANY PROCEEDING, WHETHER IN ARBITRATION OR IN COURT, SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, BOTH YOU AND SHOCKWAVE MOTO WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.


18. FORCE MAJEURE

ShockWave Moto shall not be liable for any failure or delay in performance under these Terms that results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, government action, labor disputes, supply chain disruptions, carrier delays, war, terrorism, cyberattacks, or failure of third-party platforms including Shopify.


19. MODIFICATIONS TO TERMS

ShockWave Moto reserves the right to modify these Terms at any time at our sole discretion. Updated Terms will be posted on the Site with a revised effective date. Your continued use of the Site or placement of an order after any such modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.


20. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.


21. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Refund Policy, and any other policies posted on the Site, constitute the entire agreement between you and ShockWave Moto with respect to your use of the Site and purchase of products, and supersede all prior or contemporaneous agreements, representations, or understandings, whether oral or written.


22. WAIVER

No waiver by ShockWave Moto of any breach or default under these Terms shall constitute a waiver of any subsequent breach or default. Failure by ShockWave Moto to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
